PETERBOROUGH ON (3/29/2012) – On February 23, 2012, 1191802 Ontario Limited o/a Jim Weir Custom Crushing pleaded guilty to one violation under the Environmental Protection Act for discharging noise from rock crushers into the environment, causing adverse effects to neighbouring property owners.
The Court heard that the company owns and operates several rock crushers to crush stock piles of rock and gravel into uniform road grade gravel. This crushing process generates noise. In 2010, numerous cottage owners and residents were awakened by the loud noise of construction equipment from a nearby quarry. The complaints included the loss of enjoyment of property, personal stress and the possible reduction in property values caused by what they believed to be the operation of a rock crusher.
The company was charged following an investigation by the ministry’s Investigations and Enforcement Branch.
The company was fined $10,000 plus the victim fine surcharge and was given six months to pay the fine.
