Concrete Contracting Company Fined $2,000 for Environmental Protection Act Violation

Description of Offence – The conviction relates to failing to comply with a ministry order by failing to provide written confirmation that all waste had been removed by a licensed waste hauler and disposed of at an approved waste disposal site.

Date of Offence – During the period on or about June 2017 to June 2018.

Date of Conviction – June 20, 2019

Penalty Imposed – M & M Concrete Pumping Inc. was convicted of one violation under the Environmental Protection Act and was fined $2,000 plus victim fine surcharge of $500 with one year to pay. Martin Meloche was given a suspended sentence.

Background:

M & M Concrete Pumping Inc. is in the business of concrete pumping and provides clients with other demolition/construction services. Martin Meloche is a director of the company and owns a property on Canaan Rd. in Ottawa.

In October 2016, in response to a public complaint, the ministry conducted an inspection at the site and observed a substantial amount of waste, including construction and demolition waste such as brick, concrete, rebar, and domestic waste. Mr.Meloche acknowledged that the waste came from M & M Concrete jobs.

Ministry records indicated that the site was not a ministry approved waste disposal site. Mr. Meloche was given a period of time to have the waste removed, which he failed to do. In June 2017, a ministry order was issued.

A site inspection in 2017 determined that waste was still on site. After numerous calls from the ministry, the waste was removed approximately a year after the Order deadline and almost 20 months following the first inspection.

The ministry’s Investigations and Enforcement Branch investigated and laid charges resulting in the conviction and the suspended sentence.
