Consent Decree Entered Resolving Clean Air Act Asbestos NESHAP Violations in Utah
Utah (3/3/09) – On March 3, 2009, the U.S. District Court in Utah entered a consent decree resolving violations of the Asbestos NESHAP by the Union Pacific Railroad Company (UPRR). The U.S. and the State of Utah alleged that UPRR violated the asbestos NESHAP by failing to notify the State before demolishing, removing, and disposing of 13 metal sheds that had been marked as containing asbestos. UPRR also failed to inspect any of the sheds before the demolition. The consent decree requires UPRR to pay $28,200 to the Utah Attorney General’s Office as reimbursement for investigation costs; $150,000 to the State of Utah; and $50,000 to the U.S. The Office of the U.S. Attorney in Utah was the lead agency in prosecuting and negotiating this matter.
