Harold Marcus Limited Fined $10,700 For Waste Violation
SARNIA ON (8/1/08) Harold Marcus Limited has been fined $10,700 plus a victim fine surcharge, after pleading guilty to a violation under the Environmental Protection Act.
The Court heard that the company is a waste and commodity hauler. An inspection was conducted at the Clean Harbors waste disposal site of a company trailer containing waste. The driver could not produce a copy of the Certificate of Approval authorizing the transportation of the waste. Further investigation revealed that the company had been hauling waste under a Certificate of Approval belonging to another company which ceased to exist in 2003.
The company was charged following an investigation by the Ministry of the Environments Investigations and Enforcement Branch.
The company pleaded guilty to one count of using equipment for the transportation of waste that was not part of a waste management system for which a Certificate of Approval had been issued, contrary to section 41, thereby committing an offence under section 186(1), of the Environmental Protection Act. The company was fined $10,700 plus a victim fine surcharge, and given 90 days to pay.
