Leif Grann has been fined $5,500 after being found guilty of one count under the Environmental Protection Act (EPA).
Mr. Grann is the president of Ancliffe Timber Limited which owns property in the Township of Shuniah in the District of Thunder Bay. The court heard that, in December 2003 during the process of clearing the property, Grann caused a building containing tires, coils of wire and containers, which may have held paint and other chemicals, to catch fire. The smoke from the fire negatively impacted area residents and the firefighters. An investigation by the Ministry of the Environment (MOE) found that Grann had not been duly diligent during the cleaning of his property. Currently, the property is vacant, with the exception of a few wooden sheds and buildings, and is for sale.
By discharging smoke and odour into the natural environment causing or likely to cause an adverse effect, Grann acted contrary to Section 14(1) of the EPA. He pleaded guilty to the single charge and was fined $5,500.
Justice of the Peace Bruce Leaman accepted the guilty plea and fined Grann on November 24, 2004 in the Ontario Court of Justice in Thunder Bay.
