State of Colorado’s WQCD Issues Unilateral Enforcement Order to 5000 W. 38th, LLC to Resolve Permit Violations

Denver, CO (08/10/2021) – The State of Colorado’s Water Quality Control Division today announced a Notice of Violation/Cease and Desist Order/Order for Civil Penalty (“NOV/CDO/OCP”) issued to 5000 W. 38th, LLC. The NOV/CDO/OCP, filed August 10, 2021 alleged that 5000 W. 38th violated permit requirements at a subterranean dewatering facility in the City and County of Denver. 5000 W. 38th is required to pay a $2,000 civil penalty, which will be distributed to the State of Colorado’s Water Quality Improvement Fund.
