State of Colorado’s WQCD Reaches Agreement with Hodges Farms and Dredging LLC to Resolve Violations of the Water Quality Control Act

Denver, CO (8/27/2020) – The State of Colorado’s Water Quality Control Division today announced a
Compliance Order on Consent (“COC”) with Hodges Farms and Dredging LLC resolving biosolids
violations alleged in a Notice of Violation (“NOV”). The NOV, issued December 4, 2018, alleged that
Hodges Farms and Dredging violated the Water Quality Control Act and implementing control
regulations by land applying biosolids to a filed in Weld County without a Notice of Authorization from
the Division and by applying biosolids in excess of the recommended agronomic rate. Under the COC,
Hodges Farms and Dredging will pay a $45,000.00 civil penalty via three installments, which will be
distributed to the State of Colorado’s Water Quality Improvement Fund. The COC, issued on August 27,
