State of Colorado’s WQCD Reaches Agreement with Lomas-Somerset Meadows, LLC to Resolve Water Quality Violations

 

Denver, CO (5/28/2019) – The State of Colorado’s Water Quality Control Division today announced a Compliance Order on Consent (“COC”) with California-based Lomas-Somerset Meadows, LLC resolving stormwater violations alleged in a Notice of Violation/Cease and Desist Order (“NOV/CDO”) and a Notice of Violation (“NOV”). The NOV/CDO, filed August 17, 2015, and the NOV, filed October 23, 2017, alleged that Lomas-Somerset Meadows violated the Water Quality Control Act and permit requirements at the Thompson Crossing II construction project in Larimer County. Under the COC, Lomas-Somerset Meadows will pay an $85,000.00 civil penalty, which will be distributed to the State of Colorado’s Water Quality Improvement Fund. The applicable permit was terminated on December 1, 2017.

The COC, filed on April 24, 2019, was subject to a 30-day public comment period. The COC is available for viewing at https://www.colorado.gov/pacific/cdphe/wq-compliance-orders-consent.
