Trillium Material Processing Centre Inc. Fined $20,000 for Waste Disposal Violation

LINDSAY ON (3/2/2010) ? On January 26, 2010, Trillium Material Processing Centre Inc. was fined $20,000 plus a victim fine surcharge, after being convicted of one violation under the Environmental Protection Act. The company pleaded guilty to using, operating or establishing a waste disposal site without a Certificate of Approval. The company was given 90 days to pay.

The Court heard that the company operates a waste disposal site in Toronto. Contaminated soils from a brownfield site were stored at the site and then reloaded onto trucks and taken to a facility located in Sudbury for disposal. A quantity of the contaminated waste soils had been stored in Toronto after a breakdown occurred at the facility in Sudbury. The company hired Van Drunen & Sons Gravel Limited to haul these contaminated soils to a gravel pit located in the City of Kawartha Lakes. The gravel pit did not have a Certificate of Approval to receive the waste.

Trillium Material Processing Centre Inc. and Van Drunen & Sons Gravel Limited were charged following an investigation by the Ministry of the Environment?s Investigations and Enforcement Branch. In addition to Trillium Material Processing Centre Inc. being handed down a $20,000 fine, Van Drunen & Sons Gravel Limited was convicted on September 29, 2010 and fined $10,000.
