Auburn Gasoline Station Owner Assessed $18,500 Penalty

The Massachusetts Department of Environmental Protection (MassDEP) has assessed an $18,500 penalty against Motiva Enterprises, LLC, for failing to immediately notify MassDEP and take actions to address vapors that could pose a health hazard at its gasoline station and convenience store, located at 712 Southbridge Street in Auburn.

Motiva Enterprises conducts periodic air sampling at its Auburn location as a result of a 1998 release of gasoline at the site. Air samples collected in April 2005 showed a significant increase in vapors, possibly posing an immediate health hazard. Motiva was required to notify MassDEP within 72 hours and conduct immediate actions to address the condition. The company did not notify MassDEP or take actions until July 2005.

Since that time, Motiva has taken steps to address the air contamination, including installation of a soil vapor extraction system to prevent migration of gasoline vapors into the building. MassDEP discovered the delay in notification during an audit conducted in September 2005. In addition to payment of the penalty, Motiva has agreed to continue to monitor indoor air quality.

“This case highlights the importance of timely actions where there may be a hazard to health,” said Martin Suuberg, director of MassDEP’s Central Regional Office in Worcester. “MassDEP is pleased that Motiva ultimately did take the appropriate actions.”
