Iowa DNR enforcement actions

Des Moines IA (12/15/2022) – DNR staff work with individuals, businesses and communities to help them protect our natural resources by complying with state and federal laws. This approach is very effective. In the few cases where compliance cannot be achieved, the DNR issues enforcement actions. The following list summarizes recent enforcement actions. Consent Orders
A consent order is issued as an alternative to issuing an administrative order. A consent order indicates that the DNR has voluntarily entered into a legally enforceable agreement with the other party.
Carroll County
Brian Wendl
Develop and implement a standard operating procedure for manure land application, comply with the facility’s National Pollutant Discharge Elimination System permit, and pay a $2,000 administrative penalty.
Clayton County
G. Lee Pattison
Develop and submit for approval a standard operating procedure related to manure application, implement the standard operating procedure upon approval, and pay a $5,000 administrative penalty.
Floyd County
Dan and Mike Staudt
Ensure that land application of manure is conducted by a certified manure applicator and pay a $6,000 administrative penalty.
Henry County
Brian Erickson dba Dutch Square Farms, LLC
Submit an updated emergency response plan and pay a $1,000 administrative penalty.
Jones County
Dean Wood
Cease all illegal solid waste disposal and illegal open burning; collect and properly dispose or recycle all solid waste remaining on-site and submit disposal receipts; and pay a $3,000 administrative penalty.
Dubuque County
Knuth Farms
Pay a $3,000 administrative penalty.
Administrative Orders
Responsible parties have 60 days to appeal the order or 60 days to pay the penalty.
Black Hawk County
Michael Arends
Cease all illegal solid waste disposal and illegal open burning; properly dispose or recycle all solid waste on site and submit receipts; and pay a $10,000 administrative penalty.
