Wisconsin Attorney General Peg Lautenschlager announced today the Wisconsin Department of Justice has settled an air pollution violations lawsuit filed in Brown County against Western Lime Corporation.

Western Lime produces high calcium pebble and hydrated lime at 101 James Street in Green Bay, where the air pollution violations occurred.

?Western Lime exceeded its Department of Natural Resources air permit emission limits for particulate matter, sulfur dioxide, and carbon monoxide between February and April of 2002,? Lautenschlager said. ?In addition, Western Lime failed to perform a nitrogen oxides emission test within the two-year period required by its air pollution control permit.?

In settlement, Western Lime has agreed to pay $60,000 in forfeitures, assessments, and costs. It has also agreed to propose an appropriate supplemental environmental project costing at least $120,000. If Western Lime fails to complete the supplemental environmental project, it could face up to $30,000 in additional forfeitures, assessments, and costs.

Assistant Attorney General Philip Peterson represented the state.
