Ontario – Company and Director Fined $30,000 for Environmental Protection Act Violations January 29, 2026

Description of Offences – The convictions are for operating, establishing, altering, enlarging or extending a waste management system or a waste disposal site without ministry approval.

Date of Offences – During the period beginning on or about April 21, 2022 and ending on or about June 9, 2022

Date of Convictions – April 16, 2025

Penalties Imposed –

  • 2596785 Ontario Ltd. was convicted of one violation under the Environmental Protection Act, fined $25,000 plus a victim fine surcharge of $6,250, and given one year to pay.
  • Dale Siekfer was convicted of one violation under the Environmental Protection Act, fined $5,000 plus a victim fine surcharge of $1,250, and given one year to pay.

Background –

  • At the time of the offences, 2596785 Ontario Ltd. owned a property located at 328 Talbot Street North in the Town of Essex, Ontario.
  • Dale Siekfer managed the site on behalf of the company and for his own business operations. Mr. Siekfer was responsible for the deposit and management of materials brought to the site.
  • There is a large building at the site which houses a workshop and offices. Behind the building is a large open area.
  • At the time of the violations, this area was used for the deposit and storage of waste materials including brick, concrete, steel and scrap metals, wood and wood wastes, waste asphalt pavement, used tires, end-of-life vehicles, and drums of diesel fuel.
  • Between April 2022 and June 2022, ministry officers conducted several inspections at the site. During each inspection, officers observed the presence of these waste materials being deposited, collected, handled, stored, processed and disposed of at the site.
  • The ministry has never issued an Environmental Compliance Approval for the establishment or operation of a waste disposal site or waste management system at the site.
  • The ministry’s Environmental Investigations and Enforcement Branch investigated and laid charges, which resulted in the convictions.
