Denver, CO (5/30/2024) – The State of Colorado’s Water Quality Control Division today announced a Compliance Order on Consent (“COC”) with Orica USA Inc. (“Orica”) resolving permit violations alleged in Notice of Violation/Cease and Desist Order Number DO-200909-2 (“NOV/CDO”). The NOV/CDO, filed on September 9, 2020, alleged that Orica violated discharge permit requirements at its domestic wastewater treatment facility in Arapahoe County, Colorado. Specifically, the Division alleged that Orica failed to comply with permit effluent limitations and failed to properly report. Under the COC, Orica will pay a $130,000 civil penalty, which will be distributed to the State of Colorado’s Water Quality Improvement Fund. Orica completed all required corrective actions associated with the NOV/CDO. The COC, filed May 30, 2024, was subject to a 30-day public comment period.
