Denver, CO (6/4/2024) – The State of Colorado’s Water Quality Control Division today announced a Compliance Order on Consent (“COC”) with Emcon, Inc. and Overlook Park Properties resolving stormwater violations alleged in a Notice of Violation/Cease and Desist Order (“NOV/CDO”). The NOV/CDO, filed March 10, 2020, alleged that Emcon and Overlook Park Properties violated the Water Quality Control Act and permit requirements at the Overlook Park Subdivision Project in Routt County. Under the COC, Emcon and Overlook Park Properties will pay a $67,500 civil penalty, which will be distributed to the State of Colorado’s Water Quality Improvement Fund. Emcon and Overlook Park Properties completed all required corrective actions and returned to compliance. The COC, filed on June 4, 2024, was subject to a 30-day public comment period.
