State of Colorado’s WQCD Issues Unilateral Enforcement Order to Woody Creek Metropolitan District to Resolve Administrative Permit Violations

Denver, CO (3/29/2023) – The State of Colorado’s Water Quality Control Division today announced a Notice of Violation/Cease and Desist Order/Order for Civil Penalty (“NOV/CDO/OCP”) with Woody Creek Metropolitan District resolving permit violations alleged in the NOV/CDO/OCP. The NOV/CDO/OCP filed March 29, 2023 alleged that Woody Creek Metropolitan District violated discharge permit requirements at the wastewater treatmentfacility at Woody Creek Mobile Home Park in Pitkin County, Colorado. Specifically, the Division alleged that Woody Creek Metropolitan District failed to submit discharge monitoring reports on time, as required by its permit. Under the NOV/CDO/OCP, Woody Creek Metropolitan District will pay a $5,000 civil penalty, which will be distributed to the State of Colorado’s Water Quality Improvement Fund.
