State of Colorado’s WQCD Reaches Agreement With Elam Construction, Inc. to Administrative Permit Violations

Denver, CO (8/27/2020) – The State of Colorado’s Water Quality Control Division today announced a
Compliance Order on Consent (“COC”) with Grand Junction based Elam Construction, Inc. resolving
administrative violations alleged in a Notice of Violation/Cease and Desist Order (“NOV/CDO”). The
NOV/CDO, filed January 15, 2020, alleged that Elam Construction, Inc. violated permit requirements at
its sand and gravel facilities in Moffaat, Mesa, Delta, Garfileld, and La Plata counties. Under the COC,
Elam Construction will pay a $40,000.00 civil penalty, which will be distributed to the State of
Colorado’s Water Quality Improvement Fund. Elam Construction has also completed all required
